<p style="font-size: 16px; color: black; line-height: 40px; text-align: left; margin-bottom: 15px;"><span style="color: black;">“明知或应知笔记内容不是发布者的真实经历,以营利为目的伪造笔记涉嫌虚假宣传,<span style="color: black;">按照</span><span style="color: black;">宣传</span>法、反不正当竞争法规定,以虚假宣传、引人误导的内容<span style="color: black;">诈骗</span>消费者的,属于虚假<span style="color: black;">宣传</span>,发布虚假<span style="color: black;">宣传</span>的<span style="color: black;">宣传</span>主、<span style="color: black;">宣传</span>经营者、<span style="color: black;">宣传</span>发布者要承担相应的法律责任,严重的可处20万-100万元罚款,并被吊销营业执照。”河南春屹律师事务所<span style="color: black;">专家</span>张少春告诉记者,有此类事实案例数<span style="color: black;">不堪</span>数,以医疗美容行业为例,在裁判文书网上以“医美”、“纠纷”为关键词进行搜索,<span style="color: black;">近期</span>几年这案件数量激增。</span></p>
<p style="font-size: 16px; color: black; line-height: 40px; text-align: left; margin-bottom: 15px;"><span style="color: black;">虚假宣传过程中,<span style="color: black;">宣传</span><span style="color: black;">机构</span>的<span style="color: black;">行径</span>已涉嫌违法。张少春分析,至于品牌方<span style="color: black;">是不是</span>涉嫌违法,则<span style="color: black;">必须</span><span style="color: black;">按照</span>品牌方跟<span style="color: black;">宣传</span>发布者的<span style="color: black;">详细</span>沟通内容来判断。</span></p>
<p style="font-size: 16px; color: black; line-height: 40px; text-align: left; margin-bottom: 15px;"><span style="color: black;"><span style="color: black;">按照</span>《中华人民共和国<span style="color: black;">宣传</span>法》第五十六条:违反本法规定,发布虚假<span style="color: black;">宣传</span>,<span style="color: black;">诈骗</span>、误导消费者,使购买商品<span style="color: black;">或</span>接受服务的消费者的合法权益受到损害的,由<span style="color: black;">宣传</span>主依法承担民事责任。<span style="color: black;">宣传</span>经营者、<span style="color: black;">宣传</span>发布者<span style="color: black;">不可</span><span style="color: black;">供给</span><span style="color: black;">宣传</span>主的真实名<span style="color: black;">叫作</span>、<span style="color: black;">位置</span>和有效联系方式的,消费者<span style="color: black;">能够</span><span style="color: black;">需求</span><span style="color: black;">宣传</span>经营者、<span style="color: black;">宣传</span>发布者先行赔偿。</span></p>
<p style="font-size: 16px; color: black; line-height: 40px; text-align: left; margin-bottom: 15px;"><span style="color: black;">而关系消费者生命健康的商品<span style="color: black;">或</span>服务的虚假<span style="color: black;">宣传</span>,<span style="color: black;">导致</span>消费者损害的,其<span style="color: black;">宣传</span>经营者、<span style="color: black;">宣传</span>发布者、<span style="color: black;">宣传</span>代言人应当与<span style="color: black;">宣传</span>主承担连带责任。前款规定以外的商品<span style="color: black;">或</span>服务的虚假<span style="color: black;">宣传</span>,<span style="color: black;">导致</span>消费者损害的,其<span style="color: black;">宣传</span>经营者、<span style="color: black;">宣传</span>发布者、<span style="color: black;">宣传</span>代言人,明知<span style="color: black;">或</span>应知<span style="color: black;">宣传</span>虚假仍设计、制作、代理、发布<span style="color: black;">或</span>作<span style="color: black;">举荐</span>、证明的,应当与<span style="color: black;">宣传</span>主承担连带责任。</span></p>
