    <p style="font-size: 16px; color: black; line-height: 40px; text-align: left; margin-bottom: 15px;"><span style="color: black;">综合这些<span style="color: black;">原因</span>,反对解除外链屏蔽的<span style="color: black;">关联</span>学者认为:尽管解除外链屏蔽的初衷是好的,但却会<span style="color: black;">导致</span><span style="color: black;">繁杂</span>的影响,<span style="color: black;">因此呢</span><span style="color: black;">不该</span>当由监管介入进行规制。对此观点,笔者不敢完全苟同,其中或有<span style="color: black;">许多</span>可商榷之处。<span style="color: black;">关联</span><span style="color: black;">文案</span>的分析未能结合<span style="color: black;">微X</span>等平台的垄断地位与公共<span style="color: black;">制品</span>属性,从反垄断法视角彻底分析屏蔽链接<span style="color: black;">行径</span>可能带来的影响。笔者<span style="color: black;">长时间</span>聚焦数字经济反垄断<span style="color: black;">行业</span>,2011和2012年在 《政法论坛》等<span style="color: black;">发布</span>了多篇论文。十年间,笔者深度参与了《反不正当竞争法》、《电子商务法》、《反垄断法》等<span style="color: black;">关联</span>互联网条款的制定和修订工作,对数字经济反垄断的<span style="color: black;">关联</span>理念与实践或有<span style="color: black;">有些</span>感悟。此次工信部提出解除外链屏蔽的<span style="color: black;">关联</span><span style="color: black;">措施</span>,笔者结合此前<span style="color: black;">科研</span><span style="color: black;">亦</span>有<span style="color: black;">有些</span>思考,愿在以下几个问题上与诸位商榷,以求教大方之家。</span></p>

    <p style="font-size: 16px; color: black; line-height: 40px; text-align: left; margin-bottom: 15px;"><span style="color: black;">反对解除外链屏蔽的<span style="color: black;">关联</span><span style="color: black;">文案</span>在多处<span style="color: black;">说到</span>,屏蔽链接虽然有些<span style="color: black;">不方便</span>,但只是"多一步操作<span style="color: black;">罢了</span>"。屏蔽的<span style="color: black;">状况</span>下,消费者真的只是多了一步吗?<span style="color: black;">按照</span>工信部的整改<span style="color: black;">需求</span>,其中<span style="color: black;">包含</span>了"展示和<span style="color: black;">拜访</span>形式一致""直接在应用内<span style="color: black;">拜访</span>"和"不<span style="color: black;">增多</span>额外操作<span style="color: black;">过程</span>"等三项<span style="color: black;">需求</span>,对应的是国内通信工具屏蔽<span style="color: black;">外边</span>链接的三种<span style="color: black;">平常</span>做法,<span style="color: black;">亦</span><span style="color: black;">便是</span>消费者在<span style="color: black;">拜访</span>被屏蔽的链接时所受到的<span style="color: black;">各样</span>叠加的阻挠。例如腾讯<span style="color: black;">针对</span>淘宝和抖音等<span style="color: black;">制品</span>的屏蔽,并非仅是切断了这些<span style="color: black;">制品</span><span style="color: black;">本来</span><span style="color: black;">得到</span>的"一键分享内容",<span style="color: black;">或</span>是拒绝在<span style="color: black;">微X</span>内嵌的浏览器中直接解析淘宝、<span style="color: black;">微X</span>内容<span style="color: black;">罢了</span>。消费者要正常收发和浏览通信内容,<span style="color: black;">亦</span>绝非仅需"多一步操作<span style="color: black;">罢了</span>"。消费者经常遇到的体验是:即使想把链接复制到其他浏览器打开,腾讯还会继续设置<span style="color: black;">阻碍</span>,针对性地折叠与特定企业<span style="color: black;">相关</span>的通信内容,让消费者<span style="color: black;">没法</span>全选、<span style="color: black;">乃至</span>难以复制<span style="color: black;">关联</span>链接。折叠通信内容、限制直接<span style="color: black;">拜访</span>、干扰<span style="color: black;">选取</span>和复制,这些都是腾讯正常<span style="color: black;">供给</span>即时通信服务的过程中不曾存在的,<span style="color: black;">亦</span>是世界上所有即时通信软件所不存在的。</span></p>
    <p style="font-size: 16px; color: black; line-height: 40px; text-align: left; margin-bottom: 15px;"><span style="color: black;">反对解除外链屏蔽的<span style="color: black;">关联</span>学者认为"(解除屏蔽)只是<span style="color: black;">帮忙</span>普通用户省去了手指的一个动作<span style="color: black;">罢了</span>""<span style="color: black;">并不</span>能算是屏蔽,顶多算是不兼容",另一边又将解除链接屏蔽与更大范围和程度上的"互联互通"包裹<span style="color: black;">绑缚</span>在<span style="color: black;">一块</span>。谈屏蔽时,最大限度的简化屏蔽<span style="color: black;">行径</span>的<span style="color: black;">繁杂</span>性,讲互联互通时,则把各类互联互通的<span style="color: black;">繁杂</span>问题绑在<span style="color: black;">一块</span>。<span style="color: black;">根据</span>这种做法,何来"<span style="color: black;">详细</span>的成本收益分析"呢?<span style="color: black;">实质</span>上,通信内容的屏蔽,并<span style="color: black;">不可</span>和<span style="color: black;">通常</span><span style="color: black;">道理</span>上的"互联互通"划上等号,国外法例所推动的互联互通均已在互操作性(interoperability)和数据可携权(portability)等更高级的层面。在欧美等辖区,基本通信内容的互联互通是有起码的<span style="color: black;">保证</span>的,电商企业、内容平台发布的信息并未被即时通信软件或社交网站软件基于竞争理由限制、截流或屏蔽。<span style="color: black;">针对</span><span style="color: black;">繁杂</span>的问题当然<span style="color: black;">必须</span>更<span style="color: black;">谨慎</span>妥善的处理,但将恶性<span style="color: black;">显著</span>且法律关系清晰的<span style="color: black;">基本</span>通信屏蔽,大而化之的将解除通信屏蔽和"互联互通"划上等号,实在是非常<span style="color: black;">不当</span>。</span></p>
    <p style="font-size: 16px; color: black; line-height: 40px; text-align: left; margin-bottom: 15px;"><strong style="color: blue;"><span style="color: black;"><span style="color: black;">2、</span>解除屏蔽是定价问题?</span></strong></p>

    <p style="font-size: 16px; color: black; line-height: 40px; text-align: left; margin-bottom: 15px;"><span style="color: black;">难以想象,<span style="color: black;">经过</span>给消费者<span style="color: black;">运用</span><span style="color: black;">基本</span>功能设置层层<span style="color: black;">阻碍</span>的方式,<span style="color: black;">能够</span>堂而皇之的<span style="color: black;">作为</span>一种受<span style="color: black;">守护</span>的竞争策略;而消费者<span style="color: black;">运用</span><span style="color: black;">基本</span>服务的权利、通信基本服务的质量,反而<span style="color: black;">成为了</span>一种<span style="color: black;">必须</span>额外付费的资源。事实上,工信部此次整改<span style="color: black;">需求</span>是依据《电信条例》开展的执法活动。<span style="color: black;">百姓</span>合法的通信内容不受干涉,电信业务经营者应当为用户<span style="color: black;">供给</span><span style="color: black;">快速</span>、准确、安全、方便的电信服务,这是腾讯<span style="color: black;">做为</span>增值电信业务经营者(其实早已比<span style="color: black;">基本</span>电信业务经营者还要"<span style="color: black;">基本</span>")的法定义务。腾讯以竞争目的屏蔽用户通信内容,无异于移动在听到用户<span style="color: black;">tel</span>中提及"联通"二字时便切断线路。此种<span style="color: black;">行径</span>的恶性,并不<span style="color: black;">由于</span>互联网企业有更强的技术能力就使屏蔽<span style="color: black;">行径</span>变得正当。屏蔽是一种典型的绑架消费者以实现竞争目的的<span style="color: black;">行径</span>。对合法内容无差别的传输和展示<span style="color: black;">本来</span><span style="color: black;">便是</span>即时通信软件的基本义务,屏蔽反而是一种<span style="color: black;">必须</span>付出额外投入<span style="color: black;">才可</span>实现的对<span style="color: black;">基本</span>服务水平的<span style="color: black;">卑视</span>性降低。</span></p>
    <p style="font-size: 16px; color: black; line-height: 40px; text-align: left; margin-bottom: 15px;"><span style="color: black;">即使就反对解除外链屏蔽的<span style="color: black;">关联</span><span style="color: black;">文案</span>所提的更进一步的"一键分享",<span style="color: black;">亦</span>即外接服务而言,腾讯在宣布<span style="color: black;">作为</span>开放平台时<span style="color: black;">起始</span>,就<span style="color: black;">已然</span>对其外接服务<span style="color: black;">颁布</span>了收费标准,而无论是<span style="color: black;">博客</span>、知乎、优酷还是爱奇艺的内容都<span style="color: black;">能够</span>按此标准在<span style="color: black;">微X</span><span style="color: black;">其中</span>正常分享。而抖音、虾米、网易云音乐及飞书等众多被屏蔽外接服务的企业,最初<span style="color: black;">亦</span>都按此标准进行外接分享,但仅仅<span style="color: black;">由于</span>腾讯意图投资<span style="color: black;">关联</span><span style="color: black;">行业</span>,就被掐断了服务。而这从来都不是<span style="color: black;">由于</span>这些企业不愿意付费<span style="color: black;">或</span>是<span style="color: black;">必须</span>支付<span style="color: black;">更加多</span>的<span style="color: black;">花费</span>。事实上,就来腾讯自己<span style="color: black;">亦</span>从不承认,屏蔽这些外链是<span style="color: black;">由于</span><span style="color: black;">必须</span><span style="color: black;">更加多</span>的对价,而是以莫须有<span style="color: black;">乃至</span>无中生有的"治理"规则直接封杀了其所欲染指的<span style="color: black;">行业</span>的威胁者,其直接结果<span style="color: black;">便是</span>造<span style="color: black;">成为了</span>资本在互联网<span style="color: black;">行业</span>的无序扩张,严重影响了正常的互联网生态运行。中央经济工作会议<span style="color: black;">知道</span>了2021年经济工作中的八项重点任务,“强化反垄断和防止资本无序扩张”被列为其中一项,<span style="color: black;">诱发</span>各界关注。资本的无序扩张将会<span style="color: black;">引起</span>市场垄断程度的加剧,<span style="color: black;">从而</span>扼杀创新,损害消费者利益。更危险的是,大型网络平台会利用其<span style="color: black;">能够</span><span style="color: black;">必定</span>程度<span style="color: black;">掌控</span>舆论的<span style="color: black;">优良</span>,<span style="color: black;">逐步</span>改变社会整体对垄断的态度,严重损害自由竞争的市场生态。笔者认为,平台生态内外隔离封锁的“网络孤岛”现象,是我国平台<span style="color: black;">行业</span>无序扩张形成的重要诱因,互联网企业丢千方百计将用户圈禁在自己的生态<span style="color: black;">其中</span>,企图一劳永逸的攫取用户数据满足<span style="color: black;">自己</span>发展的<span style="color: black;">必须</span>。平台的“外链屏蔽”<span style="color: black;">行径</span>无疑严重的损害了自由竞争的市场生态,<span style="color: black;">因此呢</span><span style="color: black;">必要</span>加以制止。</span></p>
    <p style="font-size: 16px; color: black; line-height: 40px; text-align: left; margin-bottom: 15px;"><span style="color: black;">再者,有学者将屏蔽问题形容为市场内的自由竞争问题,即一个巨头之"没谈好"的定价问题,<span style="color: black;">因此呢</span>监管<span style="color: black;">公司</span>既无<span style="color: black;">干涉</span>之能力,更无<span style="color: black;">干涉</span>之必要。这实在是对通信屏蔽的曲解,<span style="color: black;">亦</span>是对平台经济的误会。腾讯本身<span style="color: black;">已然</span>从<span style="color: black;">作为</span>开放平台<span style="color: black;">其中</span><span style="color: black;">得到</span>了巨大利益,<span style="color: black;">经过</span>引入尽可能多的第三方丰富了其平台的内容,进一步巩固了网络效应,实现了用户留存。业界对腾讯"左手关系链,右手投资""用流量换资源"的业务<span style="color: black;">规律</span>都不会陌生,而"拿出半条命来做开放平台""腾讯开放的<span style="color: black;">前门</span>打开就永远不会关上"<span style="color: black;">亦</span>仍旧是言犹在耳。3Q案之后,腾讯实施开放平台并从中获益,完<span style="color: black;">成为了</span>从桌面端到移动端的跃迁,<span style="color: black;">亦</span>从单纯的即时通信工具转变为基于社交关系链资源搭建的"生态"和"超级平台",公众号、小程序、视频号、微店等等<span style="color: black;">微X</span>开放平台上连接的数以千万计的<span style="color: black;">研发</span>者、创作者都是<span style="color: black;">帮忙</span>搭建和巩固了<span style="color: black;">微X</span>的网络效应,使其<span style="color: black;">作为</span>几乎所有<span style="color: black;">平常</span>互联网<span style="color: black;">行径</span>最高频、最常用的入口和守门人。腾讯将"开放平台策略"演绎到了极致,这是腾讯<span style="color: black;">宣传</span>和其他一切业务收入的<span style="color: black;">基本</span>。<span style="color: black;">然则</span>,腾讯却在承诺对外<span style="color: black;">广泛</span>开放的<span style="color: black;">基本</span>上,在其自己试图进入或投资的<span style="color: black;">行业</span>对竞争对手实施屏蔽和限制,<span style="color: black;">增多</span>消费者<span style="color: black;">运用</span>时的摩擦。</span></p>
    <p style="font-size: 16px; color: black; line-height: 40px; text-align: left; margin-bottom: 15px;"><span style="color: black;">该学者还认为,行业监管和反垄断执法只能"二选一"。<span style="color: black;">针对</span>这一观点,供水供电等公用<span style="color: black;">基本</span><span style="color: black;">设备</span>,石油、烟草等强监管行业的反垄断执法案件<span style="color: black;">本来</span><span style="color: black;">便是</span>比比皆是,行业监管和反垄断监管<span style="color: black;">一起</span>从事先和事后对经济活动进行规制。屏蔽问题<span style="color: black;">触及</span>通信自由和通信质量,由工信部依据通信法规出手治理自然是于法有据、顺理成章,但屏蔽问题本质还<span style="color: black;">触及</span>通信平台<span style="color: black;">经过</span>屏蔽<span style="color: black;">行径</span>将市场力量延伸到其他<span style="color: black;">行业</span>,干扰这些<span style="color: black;">行业</span>的竞争。这本质上是一个反垄断问题,即<span style="color: black;">乱用</span>市场<span style="color: black;">安排</span>地位,排除、限制其他<span style="color: black;">行业</span>竞争的问题。除了<span style="color: black;">根据</span>通信法规整改外,腾讯<span style="color: black;">亦</span>应当依法承担反垄断法下的责任。</span></p>
