<p style="font-size: 16px; color: black; line-height: 40px; text-align: left; margin-bottom: 15px;"><span style="color: black;"><span style="color: black;">(2)甲方在符合<span style="color: black;">关联</span>法律、法规规定的情形下需辞退被派遣员工的,应提前三十日<span style="color: black;">或</span>额外支付<span style="color: black;">一月</span>工资<span style="color: black;">做为</span>代<span style="color: black;">通告</span>金的前提下书面<span style="color: black;">通告</span>乙方并说明退工理由和日期。退工单一式三份,一份存根,一份交被派遣员工,一份交乙方。乙方在接到甲方开具的退工<span style="color: black;">通告</span>单后,应予以接收并负责办理解聘手续。</span></span></p>
<p style="font-size: 16px; color: black; line-height: 40px; text-align: left; margin-bottom: 15px;"><span style="color: black;"><span style="color: black;">(3)被派遣员工个人提出辞职,提前三十日书面<span style="color: black;">通告</span>甲方,甲方应在二十日内以书面形式(并附被派遣员工的辞职申请)<span style="color: black;">通知</span>乙方,由乙方办理<span style="color: black;">相关</span>解聘等手续。如甲方需被派遣员工保守<span style="color: black;">商场</span><span style="color: black;">奥密</span>,由甲方与被派遣员工直接订立保密协议供被派遣员工遵守履行。</span></span></p>
<p style="font-size: 16px; color: black; line-height: 40px; text-align: left; margin-bottom: 15px;"><span style="color: black;"><span style="color: black;"> (4)因甲方<span style="color: black;">无</span><span style="color: black;">即时</span>书面<span style="color: black;">通知</span>乙方退工事宜的,或甲方退工事由不成立的(由劳动仲裁<span style="color: black;">分部</span>或人民法院认定),由此<span style="color: black;">导致</span>乙方需向被派遣员工支付的工资、社保<span style="color: black;">花费</span>以及依法需对被派遣员工支付的其他<span style="color: black;">花费</span>均由甲方承担。</span></span></p>
<p style="font-size: 16px; color: black; line-height: 40px; text-align: left; margin-bottom: 15px;"><span style="color: black;"><span style="color: black;"> <span style="color: black;">5、</span><span style="color: black;">花费</span>的结算</span></span></p>
<p style="font-size: 16px; color: black; line-height: 40px; text-align: left; margin-bottom: 15px;"><span style="color: black;"><span style="color: black;">1.甲方按时(每月 号前)向乙方<span style="color: black;">供给</span>当月被派遣员工的劳动<span style="color: black;">报答</span>分解表及增减员表(电子邮件或传真),并将各项<span style="color: black;">花费</span>划入乙方指定的银行账户。乙方在收到各项<span style="color: black;">花费</span>和劳动<span style="color: black;">报答</span>分解表后五个工作日内须向甲方出具各项<span style="color: black;">花费</span>的正式票据。<span style="color: black;">花费</span>未到乙方账户,本协议约定的<span style="color: black;">关联</span>条款,如工伤等各项社会保险<span style="color: black;">没法</span>缴交,发票<span style="color: black;">没法</span>开具,工资<span style="color: black;">没法</span><span style="color: black;">即时</span>发放的,责任由甲方承担。</span></span></p>

<p style="font-size: 16px; color: black; line-height: 40px; text-align: left; margin-bottom: 15px;"><span style="color: black;"><span style="color: black;"> (1)被派遣员工的<span style="color: black;">休憩</span>休假制度按甲方依法制定的规章制度执行。</span></span></p>
<p style="font-size: 16px; color: black; line-height: 40px; text-align: left; margin-bottom: 15px;"><span style="color: black;"><span style="color: black;">(2)遵守国家劳动法律、法规,被派遣员工享有与甲方员工同工同酬的权利,对被派遣员工实行与其同类岗位劳动者相同的劳动<span style="color: black;">报答</span>分配办法,并<span style="color: black;">按照</span>甲方<span style="color: black;">实质</span><span style="color: black;">状况</span>,依法制定对被派遣员工的管理规定与办法,书面<span style="color: black;">通知</span>被派遣员工,<span style="color: black;">同期</span><span style="color: black;">供给</span>乙方一份备案。</span></span></p>
<p style="font-size: 16px; color: black; line-height: 40px; text-align: left; margin-bottom: 15px;"><span style="color: black;"><span style="color: black;"> (3)<span style="color: black;">定时</span>组织对被派遣员工进行思想、生产技术、安全等方面的培训和教育,以适应甲方生产工作需要。</span></span></p>
<p style="font-size: 16px; color: black; line-height: 40px; text-align: left; margin-bottom: 15px;"><span style="color: black;"><span style="color: black;">(4)在符合国家劳动法律、法规规定范围内和本协议依法约定条款的情形下,对被派遣员工有退工权,并按国家法律和<span style="color: black;">地区</span>性法规规定向乙方支付退工的<span style="color: black;">赔偿</span>金或赔偿金。</span></span></p>
<p style="font-size: 16px; color: black; line-height: 40px; text-align: left; margin-bottom: 15px;"><span style="color: black;"><span style="color: black;"> (5)若因甲方存在《民法典》第三十八条所列情形之一的,<span style="color: black;">引起</span>被派遣员工向乙方主张连带赔偿责任的,则由甲方承担<span style="color: black;">所有</span>的经济<span style="color: black;">赔偿</span>和赔偿责任。</span></span></p>
<p style="font-size: 16px; color: black; line-height: 40px; text-align: left; margin-bottom: 15px;"><span style="color: black;"><span style="color: black;"> (6)<span style="color: black;">协同</span>乙方做好被派遣员工劳动合同终止工作。</span></span></p>
<p style="font-size: 16px; color: black; line-height: 40px; text-align: left; margin-bottom: 15px;"><span style="color: black;"><span style="color: black;">(7)被派遣员工在甲方单位服务<span style="color: black;">时期</span>,被派遣员工因执行工作任务<span style="color: black;">导致</span>他人损害的或遭受第三人侵害的,由甲方承担相应经济赔偿责任。乙方有过错的,承担相应的<span style="color: black;">弥补</span>责任。</span></span></p>
<p style="font-size: 16px; color: black; line-height: 40px; text-align: left; margin-bottom: 15px;"><span style="color: black;"><span style="color: black;"> (8)为<span style="color: black;">保证</span>被派遣员工的合法权益,乙方<span style="color: black;">拜托</span>甲方组建工会组织并同意被派遣员工参加甲方的工会组织。</span></span></p>
<p style="font-size: 16px; color: black; line-height: 40px; text-align: left; margin-bottom: 15px;"><span style="color: black;"><span style="color: black;">(9)被派遣员工人数及工资相对应的残疾人就业<span style="color: black;">保证</span>金由甲方在协议期内每年3月31号前将前一征缴年度的残疾人就业<span style="color: black;">保证</span>金汇入乙方帐户,由乙方汇总缴交。若甲方<span style="color: black;">需求</span>被派遣员工与甲方员工一并计算汇总由甲方缴交的,甲方向乙方<span style="color: black;">供给</span>缴交凭证和花名册。</span></span></p>
<p style="font-size: 16px; color: black; line-height: 40px; text-align: left; margin-bottom: 15px;"><span style="color: black;"><span style="color: black;"> 2.乙方的责任、权利和义务</span></span></p>
<p style="font-size: 16px; color: black; line-height: 40px; text-align: left; margin-bottom: 15px;"><span style="color: black;"><span style="color: black;"> (1)负责<span style="color: black;">创立</span>、解除与被派遣员工的劳动关系。</span></span></p>
<p style="font-size: 16px; color: black; line-height: 40px; text-align: left; margin-bottom: 15px;"><span style="color: black;"><span style="color: black;"> (2)<span style="color: black;">按照</span><span style="color: black;">相关</span>规定,办理被派遣员工的合法聘用手续。</span></span></p>

<p style="font-size: 16px; color: black; line-height: 40px; text-align: left; margin-bottom: 15px;"><span style="color: black;"><span style="color: black;"> (6)<span style="color: black;">即时</span>向甲方通报<span style="color: black;">相关</span>国家、省、市劳动<span style="color: black;">保证</span>方面的新政策规定,<span style="color: black;">帮助</span>甲方做好相应的<span style="color: black;">调节</span>工作。</span></span></p>
<p style="font-size: 16px; color: black; line-height: 40px; text-align: left; margin-bottom: 15px;"><span style="color: black;"><span style="color: black;"> (7)在每月收到甲方支付的被派遣员工劳动<span style="color: black;">报答</span>后,应按协议约<span style="color: black;">按时</span>间按时足额发放被派遣员工当月劳动<span style="color: black;">报答</span>。</span></span></p>

<p style="font-size: 16px; color: black; line-height: 40px; text-align: left; margin-bottom: 15px;"><span style="color: black;"><span style="color: black;">1.本协议经甲乙双方签章即生效。在本协议有效期内,甲、乙双方不得擅自变更<span style="color: black;">或</span>解除本协议;如遇特殊情形需变更或解除的,一方需书面<span style="color: black;">通告</span>对方,双方协商<span style="color: black;">处理</span>。</span></span></p>

<p style="font-size: 16px; color: black; line-height: 40px; text-align: left; margin-bottom: 15px;"><span style="color: black;"><span style="color: black;"> 3.甲、乙双方均应按本协议约定事项履行各自的责任和义务;若甲、乙双方在履行本协议过程中<span style="color: black;">出现</span><span style="color: black;">关联</span>争议纠纷的,应由争议方书面<span style="color: black;">通知</span>对方争议内容,双方可协商<span style="color: black;">处理</span>,如协商不成,按下述第 种方式<span style="color: black;">处理</span>:</span></span></p>
